Hedge Funds Care Web Site Privacy Policy
Hedge Funds Care ("HFC," "we," "us") shares the concerns of visitors ("Visitors," "you") to our Internet world wide web site (located at http://www.hedgefundscare.org/ (the "Site")), which is hosted in the United States, about the protection of your personal information online. This privacy policy (the "Policy") describes our practices regarding the privacy of information that we collect through the Site, which is hosted and operated from the United States. This Policy does not govern our collection of information through any web site, or by any other means, other than through the Site, or the collection of information by any of our sponsors or local chapters collectively, "Affiliated Entities").
By using the Site, you agree to the terms and conditions of this Policy. If you do not agree to the terms and conditions of this Policy, please do not use the Site.
This Policy represents the sole, authorized statement of HFC’s practices with respect to the collection of Personal Information (defined below) through the Site and HFC’s use of such information. Any summaries of this Policy generated by third party software or otherwise (for example, in connection with the "Platform for Privacy Preferences" or "P3P") shall have no legal effect, do not bind HFC, shall not be relied upon in substitute for this Policy, and neither supersede nor modify this Policy. This Policy is in the English language. Any translation of this Policy shall have no legal validity. In the event of any inconsistency between the English language version hereof and any translation of this Policy into another language, this English language version will govern.
Children’s Online Privacy Protection Act.
We comply with the Children’s Online Privacy Protection Act of 1998 ("COPPA"). COPPA requires that web site operators never knowingly request personally identifiable information from anyone under the age of 13 without requesting verifiable parental consent.
In accordance with COPPA, we do not knowingly collect any personally identifiable information from children under the age of 13. We request that no one under the age of 18 submit personally identifiable information to our Site, and encourage parents to monitor and participate in their children’s activities on the Internet. In the event that we determine that a user of this Site is under the age of 13, we will not maintain or use his or her personally identifiable information.
1. Information HFC Gathers Through the Site.
HFC gathers two basic types of information through the Site: "Personal Information" (for purposes of this Policy, information from which an individual can be identified), which you may but are not required to provide to HFC, and "Aggregate Information," which HFC automatically gathers through your use of the Site.
a. Personal Information. You do not have to provide Personal Information to use the Site. However, in order for you to take advantage of particular opportunities provided through the Site (for example, to make a donation or purchase a ticket for a benefit, function or other event), we may require that you furnish Personal Information. We collect Personal Information from you only when you voluntarily provide it to us — for example, in purchasing event tickets; answering surveys and polls; entering contests, sweepstakes, raffles and similar promotions; registering to receive email newsletters; and making donations. Personal Information may include, without limitation, your contact information (such as your name, postal address, telephone numbers and/or email address), and your payment information, such as credit card number and expiration date (such payment information, your "Payment Information").
b. Aggregate Information. When you visit and interact with the Site, HFC and third parties with whom HFC has contracted to provide services to HFC may collect information concerning your actions — for example, a catalog of the Site pages you visit. This type of information is generally collected from two sources: server log files, and cookies.
i. Server Log Files. Your Internet Protocol (IP) address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all Visitors, to calculate Site usage levels, to help diagnose problems with the Site’s servers, and to administer the Site. We also reserve the right to use IP addresses to communicate with Visitors and, if necessary, to block access by Visitors who fail to comply with our Terms of Service. Collecting IP addresses is standard practice on the Internet and is done automatically by many web sites.
ii. Cookies. Cookies are data that a web server transfers to an individual’s computer for recordkeeping purposes. Cookies are an industry standard used by most web sites, and can facilitate users’ ongoing access to and use of a particular web site. Cookies do not cause damage to your computer systems or files, and only the web site that transferred a particular cookie can read, modify or delete such cookie. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular web site, to your computer. You should note, however, that declining cookies may make it difficult for you to use the Site.
2. Use and Disclosure of Information HFC Gathers Through the Site.
a. Personal Information. HFC may use your Personal Information to provide you with newsletters and other emails updating you on HFC and Affiliated Entity news and events. You may opt-out of receiving these newsletters and other emails from us at any time (see "Opt-Out," below). We will not share your Personal Information with third parties, other than as set forth in this Policy.
When you make a donation, contribution or purchase through the Site (a "Transaction"), we may collect Payment Information from you related to such Transaction, and may use such Payment Information in order to complete your Transaction and, if applicable, to fulfill your purchase. We may also provide such Payment Information to third parties as necessary to complete your Transaction (for example, to process your credit card).
We may operate sweepstakes, contests, raffles and similar promotions through the Site. We typically ask you for certain of your Personal Information when you enter and, if applicable, win any sweepstakes, contest, raffle or similar promotion. We reserve the right to share this Personal Information with third parties sponsors of such sweepstakes, contests, raffles and promotions (irrespective of whether it is hosted by us), or otherwise in accordance with the rules applicable to such sweepstakes, contest, raffle or promotion. You should carefully review the rules of each sweepstakes, contest, raffle and promotion in which you participate through the Site, as they may contain additional important information about HFC’s or a sponsor’s use of your Personal Information. To the extent that the terms and conditions of such rules concerning the treatment of your Personal Information conflict with this Policy, the terms and conditions of such rules shall control.
From time to time, in our sole discretion, we may use your Personal Information to email you important information regarding the Site, your Transactions, or changes to our terms, conditions, and policies ("Critical Emails"). Because this information may be critical to your use of the Site, you may not opt-out of receiving these emails.
Finally, notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose your Personal Information if we believe that we are required to do so (a) by law; (b) to comply with legal process or governmental requests; (c) to enforce our Terms of Service; (d) to protect our operations or those of any Affiliated Entities; (e) to protect the rights, privacy, safety or property of HFC, the Affiliated Entities, you or others; and (f) to permit us to pursue available remedies or limit the damages that we may sustain. As another example, we may, to the fullest extent the law allows, disclose Personal Information about you to law enforcement agencies to assist them in identifying individuals who have been or may be engaged in unlawful activities.
b. Aggregate Information. We analyze Aggregate Information in order to track the popularity of certain pages of the Site, the success of our email notifications, traffic levels on the Site and other usage data, all of which helps us to improve the Site, related services, and our charitable campaigns, and to gauge interest in the Site and HFC. We reserve the right to share Aggregated Information, which does not personally identify you, with Affiliated Entities and other third parties, for any purpose.
4. Other Important Notes Regarding Our Privacy Practices.
a. Third Party Service Providers. We work with third parties who provide services including but not limited to web site hosting, credit card processing, data analysis, newsletter services, and other services of an administrative nature. We reserve the right to share your Personal Information, including your Payment Information, with such third parties solely for the purpose of enabling such third parties to provide such services.
b. Security. We have security measures and tools, such as firewalls, in place to help protect against the loss, misuse, and alteration of the information under our control. Additionally, any time you provide us with your credit card number, that credit card number is transmitted to us by your browser in an encrypted format using industry-standard, SSL (secure socket layer) encryption. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, although we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to us through or in connection with the Site. No method of transmitting or storing data is completely secure. You acknowledge and agree that any information you transmit through the Site is so transmitted at your own risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with "Contacting Us," below (note that physical mail notification will delay the time it takes for us to respond to the problem).
c. Third Party Sites. The Site may contain links to third party web sites. These linked sites (including without limitation the web sites of Affiliated Entities) are not under HFC’s control and we are not responsible for the privacy practices or the contents of any such linked site, or any link contained in any linked site. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by HFC or any Affiliated Entities. If you provide Payment Information or other Personal Information through any such third party web site, your transaction will occur on such third party’s web site (not the Site) and the Personal Information you provide will be collected by, and controlled by the privacy policy of, that third party. It is important that you familiarize yourself with the privacy policies and practices of any such third parties. PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.
d. Opting-Out and Removing your Personal Information. From time to time, we may ask you to indicate whether you are interested in receiving emails and other information from HFC. If you elect, by not opting-out, to receive these communications, we will occasionally send you emails or other information that matches your requests. Later, you may elect not to continue to receive these communications from us (excluding Critical Emails) by following the “unsubscribe” instructions at the bottom of any such email. You may also remove your Personal Information from our database by contacting us either by email at DThompson@hedgefundscare.org with the subject line, "REMOVE MY INFORMATION," or by regular mail at 70 W. 36th Street, Suite 1404, New York, NY 10018 in order to stop receiving these communications (excluding Critical Emails) from us. In each event, you must clearly indicate that you wish to have your Personal Information removed from our database. We will endeavor to comply with your request as soon as reasonably possible.
We may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed therefrom. We also reserve the right, from time to time, to re-contact former users of the Site. Finally, we are not responsible for removing information from the databases of third parties with whom we have already shared your Personal Information.
e. Changing Your Personal Information. In order to inform us of changes to your Personal Information, please contact us either by email at DThompson@hedgefundscare.org with the subject line, "CHANGE MY INFORMATION," or by regular mail at 70 W. 36th Street, Suite 1404, New York, NY 10018. In each event, you must clearly indicate the information that you wish to have changed. We will endeavor to comply with your request as soon as reasonably possible. Note that even if you elect to change your information in our database, there may be residual, outdated information that will remain within our databases and other records, which will not be removed. Also note that we are not responsible for informing third parties of any changes requested pursuant to this Section.
f. Changes to This Policy. We reserve the right to change this Policy, and any of our policies or procedures concerning the treatment of information collected through the Site, without prior notice. You can determine when this Policy was last revised by referring to the "Last Updated" legend at the top of this page. Any changes to our Policy will become effective upon posting of the revised Policy on the Internet, accessible through the Site. Use of the Site following such changes constitutes your acceptance of the revised Policy then in effect. We encourage you to bookmark this page and to periodically review it to ensure familiarity with the most current version of our Policy.
